1. Introduction

Welcome to MyBACoach, a product of Tech Varsity. By engaging our coaching, training, or consulting services, you agree to comply with and be bound by these Terms and Conditions.

2. Definitions

• “Services”: Refers to coaching, digital training (via LMS), and BA/technical consulting provided by MyBACoach.
• “Client”: Any individual or organization engaging our services.
• “Intellectual Property (IP)”: Includes, but is not limited to, the Project Handbooks, training videos, templates, and frameworks provided.

3. Service Delivery & Client Responsibilities

• Coaching/Consulting: You are responsible for providing accurate project details and CVs/information for review.
• Course Access: For LMS-based training, you are granted a non-transferable, personal license to use the course materials. Sharing login credentials is a breach of these terms.
• Cooperation: You agree to attend scheduled sessions on time. Missed sessions without 24 hours’ notice may be forfeited.

4. Fees and Payment

• Fees are as stated in your specific Service Agreement or checkout page.
• For corporate clients, late payments may be subject to interest at the statutory rate applicable in the jurisdiction of the invoice.

5. Intellectual Property

• All materials provided (including but not limited to Project Handbooks) are the proprietary property of MyBACoach.
• Usage: Clients are granted a limited license for personal or internal business use only. Reselling, redistributing, or “white-labeling” our frameworks as your own is strictly prohibited.

6. Confidentiality & Data Privacy

We adhere to the UK GDPR and the Nigeria Data Protection Act (NDPA). Please refer to our Privacy Policy for how we handle your data.

7. Termination

• Either party may terminate the agreement with written notice.
• Non-Refundable Policy: Digital product purchases (LMS courses) are generally non-refundable once accessed. Consulting services rendered up to the date of termination are billable.

8. Limitation of Liability & Disclaimers

• Outcome Disclaimer: MyBACoach provides educational and strategic guidance. We do not guarantee specific career or project outcomes (e.g., job placement or guaranteed project approval).
• Liability Cap: MyBACoach’s total liability shall not exceed the amount actually paid by the client for the specific service in question.

9. Governing Law & Dispute Resolution

• Dual Jurisdiction: Given our hybrid structure, these terms are governed by the laws of England and Wales. However, you acknowledge that enforcement of contracts may be sought in the courts of either the UK or Nigeria depending on where the services were primarily delivered or where the respondent is based.
